Americans with Disabilities Act for Public Pools

ADAPool accessibility has become a hot topic in Washington, D.C.

A second congressional bill addressing the Americans with Disabilities Act has been introduced.

On March 26, Congressman Mick Mulvaney (R-S.C.) introduced H.R. 4256, calling for a one-year extension of the ADA deadline for public pools. If passed, the bill also would allow portable lifts and sharing of lifts between vessels. It would prohibit lawsuits against pool and spa facilities for ADA violations alleged to occur between March 15, 2012, and one year after enactment of the bill.

“Congressman Mulvaney believes portable lifts and shared lifts are the best solution…,” said Mulvaney spokesperson Danielle McAdaragh. “It allows for lift accessibility and safety, as well as being more economically achievable…”

The bill has 26 original co-sponsors. Ron Paul (R-Texas) is among the most recognized, and Mike Ross (D-Ark.) is the only Democrat.

In early March, Mulvaney joined 67 members of Congress in a letter to the U.S. Department of Justice, which enforces the ADA, decrying its decision not to allow portable lifts or sharing. In addition, he took issue with the timing of the decision, which came 45 days before the deadline. “In that short time, approximately 309,000 pools or spas would need their own individual lifts,” McAdaragh said. The letter asked the DOJ to, at the very least, extend the deadline by six months.

“Once Congressman Mulvaney saw the strain placed on small-business owners who were rushed to [comply], and the concern for the safety of those using pool lifts, he decided to introduce [the bill],” McAdaragh said.

Though the Association of Pool & Spa Professionals is analyzing the language, its director of government affairs, Jennifer Hatfield, expressed support for the portable-lift allowance. “We believe that’s what the initial 2010 standards allowed for,” she said.

H.R. 4256 isn’t alone. On March 12, Sen. Jim DeMint (R-S.C.) introduced S. 2186, which would prohibit the federal government from enforcing the ADA standards on public pools and spas.

On March 15, the original compliance deadline, the DOJ granted a 60-day extension with a six-month reprieve being considered.

The issue has received coverage in the mainstream press, with outlets such as CNN and the South Florida Sun Sentinel discussing the pool requirements.

All this attention follows lobbying efforts by organizations from the pool, aquatics and hospitality industries. A key player has been the American Hotel & Lodging Association. It routinely conducts legislative “fly-ins,” whereby its members travel to Capitol Hill to meet with congressional representatives and senators. This year, approximately 250 AH&LA members met with about 300 legislators, with the ADA issue among its priorities.

Of the two bills, the second has been the most positively received. “It allows us to meet the requirements and needs of [people] with disabilities, but in a reasonable way,” said Kevin Maher, senior vice president of governmental affairs at the American Hotel & Lodging Association. “This legislation supports what we’ve been asking for all along.”

Still, given a truncated legislative season to accommodate this year’s campaigning, not to mention a glut of bills working their way through Congress, experts acknowledge it will be an uphill battle.

Though APSP and the AH&LA have not taken a position on the DeMint bill, they have expressed appreciation, saying it may have helped spur the latest activity.

Chlorine Vs Salt – the continual battle

The debate of chlorine vs salt pools has been going on for a long time, and there are advantages and disadvantages to both.  Maintenance, cost and health concerns are the main reasons for debate, but there does not appear to be a clear-cut winner. Based on your personal needs and wants, only you can make the decision what is best for you!

Saltwater Pools

Saltwater pools use dissolved salt through a salt chlorinator unit instead of chlorine tablets to sanitize and clean the water. The pH levels of the water must be maintained on a regularly as a steady salt-to-water ratio level must be maintained. The weekly or monthly amount of salt you add would depend on the amount of rain, the amount of backwashing done to the pool, as well as the amount of water lost due to splashing or draining of the water or regular evaporation.

Once you have added salt to your pool, you will only add extra salt over time to maintain the needed levels. Salt does not “disappear” from water once it is there, which is why the initial up-front cost of the salt is more than chlorine, but why the cost goes down significantly over time.
Salt Water Pool Advantages:
  • Less maintenance
  • Lower overall cost
  • Levels of chlorine (byproduct of the salt) are much lower so they won’t sting your eyes, are safer on skin and hair
  • Far less damaging chemicals

Chlorine Pools

Chlorine pools are the most common types of pools. The chlorination system is easy to operate, and pool owners often feel better about maintaining their pool as the chlorine tablets are readily available from pool stores and other major retailers. Pool owners add chlorine tablets to either a pump unit separate from the pool or in a floating device that dilutes the chlorine tablets over time.

 

Chlorine pool water should be regularly checked with a kit and chlorine tablets added based on the pH levels needed to balance the water. Chlorine makes it safer to swim by killing mildew, mold buildup and bacteria in the water. Chlorine pools require a bit more maintenance and potentially end up costing more overall because of the amount of chlorine needed over time.
Chlorine Pool Advantages:
  • May be better at clearing bacteria in water than salt
  • Clears up water quicker.  Clearing the water up in a chlorine system can take 24 to 48 hours, where saltwater systems may take 3 to 5 days depending on levels
  • Easy to operate as you simply add tablets

Whether you choose to clean your pool with chlorine or salt is definitely a personal choice. Either way, keeping your pool clean and free of bacteria is an important part of pool care and your families health.

Reasons to Swim in 2012

With New Year’s here, a lot of us make New Year’s Resolutions…. many of our resolutions fail, but some of them are at least worthy of putting in a great effort!!!!  In putting Michael Phelps’ quote into my own words “In my own mind, doing ____ couldn’t be done, or won’t be followed through with, but all it takes is imagination!!!”  SO, for those of us who have made exercising more one of our resolutions – I wanted to share some of the REASONS WHY SWIMMING WOULD BE A GREAT EXERCISE CHOICE in 2012!

  1. Helps Your Heart and Lungs!!!  Swimming works the heart and lungs. This trains the body to use oxygen more efficiently, which is generally reflected in declines in the resting heart rate and breathing rate.
  2. Makes You Stronger!!!  Swimming builds longer, leaner muscles that complement the shorter denser muscles that develop from weight training. These “swimmer’s muscles” also help boost metabolism to keep calories burning longer.
  3. Increases Flexibility!!!  A heated pool relaxes muscles, increasing flexibility and enabling important stretching.
  4. Very Low Chance of Injury!!!  Water supports and cushions the body, eliminating the kind of pounding associated with running and other high impact activities. Because it’s easy on the joints and muscles, swimming is often recommended for people with arthritis and other chronic conditions. The resistance of water also allows you to work out vigorously with little chance of injury.
  5. Helps Lower Stress!!! (and come on now – we all could use a little stress reliever). There’s a relaxing, meditative side to swimming. It can come with letting your mind drift as you are bathed by soothing water, focusing on your breathing and your movements. This stress-busting aspect also contributes to the cardiovascular benefits of swimming.
  6. Helps Your Lose Weight!!!  OK, that one just sells itself.
  7. Great for All Ages!!! From infants to the elderly, swimming is the kind of activity you can do across the life span, and needn’t given up late in life.

These are great reasons to swim, but if swimming isn’t for you, let’s use our imaginations (even if its just a vision of following through on something we’ve never done before) and make it happen! Happy New Year’s Everyone!!!!
